These Terms of Service (“Terms”) govern your access to and use of the Zen Create website and online store (the “Services”). By accessing, browsing, or purchasing from Zen Create, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

About Zen Create

Zen Create is a brand operated by EnlightenZen. Zen Create operates as an online retailer offering a range of products, including items sourced from third-party suppliers as well as products created or customized by Zen Create.

Eligibility

By using the Services, you confirm that you are at least the age of majority in your jurisdiction and legally capable of entering into a binding agreement.

Third-Party Brands

Zen Create operates as an independent retailer and reseller of certain third-party branded products, including fragrance products supplied by external manufacturers. Zen Create is not affiliated with, endorsed by, or the official owner of any third-party brands unless explicitly stated. All trademarks and brand names remain the property of their respective owners.

Products and Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or update product information at any time without prior notice.

Product images and descriptions are provided for general reference. While we strive for accuracy, slight variations may occur.

Pricing and Payment

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices may change without notice.

Payment must be completed in full before an order is confirmed. Orders will not be processed until payment is successfully received.

Order Confirmation

An order confirmation email does not constitute acceptance of your order. Zen Create reserves the right to cancel or refuse any order for reasons including stock availability, pricing errors, or suspected fraud.

Collection Only (No Shipping)

Zen Create currently operates on a collection-by-arrangement only basis. We do not offer courier or shipping services at this stage.

Collection details will be communicated privately after order confirmation and payment. Customers are responsible for collecting orders within the agreed timeframe.

Risk and Responsibility on Collection

Once an order has been collected, the risk of loss or damage passes to the customer. Customers are encouraged to inspect items at the time of collection.

Returns and Refunds

Returns and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms. Due to hygiene reasons, opened or used fragrance products cannot be returned or refunded.

Use of the Website

You agree not to misuse the Services, including but not limited to attempting unauthorized access, interfering with site functionality, or engaging in fraudulent activity.

Intellectual Property

All content on this website, including text, images, logos, and branding, is the property of Zen Create or its licensors and may not be used, copied, or reproduced without prior written permission.

Limitation of Liability

To the fullest extent permitted by law, Zen Create shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Services or products purchased.

Nothing in these Terms limits any rights you may have under the South African Consumer Protection Act.

Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process personal information in accordance with POPIA.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.
